The Congolese government actively encourages investment in renewable energies by offering attractive tax incentives to promote the integration of ecological solutions in the real estate sector, such as Law no. 004 of February 21, 2002 on the investment code, which sets out the conditions, advantages and general rules applicable to national and foreign direct investments, made in the Democratic Republic of Congo in sectors not expressly reserved for the State by law, and which are not excluded by the negative list appearing in Article 3 of this law, Decree No. 11/17 of June 10, 2011 on tax exemptions for renewable energies, the first act of which enshrines exemption from customs duties is the decree bearing number 15/009 of April 28, 2015, published in the Journal officiel de la RDC: Article 1 states: “Electrical energy, capital goods, equipment, tools and spare parts imported and intended exclusively for the production, transmission, distribution and marketing of electricity as well as for the exploitation of solar energy and any other renewable energy source are subject to the tariff of import and export duties and taxes instituted by Ordinance-laws n° 011/2012 and 012/2012 of  September 21, 2012”.
